Tratamiento Jurídico de los Páramos en Colombia y su Necesidad de Regulación.

Abstract

The present research project will analyze, from the existing public policies, the administrative procedure that has been established for the protection of the moors in Colombia under the regulatory framework for the protection of the páramos which includes the Political Constitution of Colombia, Law 99 of 1993 on the management and conservation of water resources, Law 1930 of 2018 through which provisions are issued for the integral management of moorlands in Colombia, Law 1753 of 2015 on the regime of protected areas and CNBS resolution 047 of 2017 on the guidelines for the preparation of management plans and sustainable use of the páramos.

Once the established procedure is analyzed, the gaps that exist in the regulations will be determined to give effective applicability. The research project will address two legal criteria, as alternatives to overcome such regulatory gaps, among which such concepts will be developed, and later the way in which they are absent in the established administrative procedure.

The legal criteria that will be analyzed will have a constitutional, jurisprudential and doctrinal development. The protection of the páramos in Colombia, having great importance in economic development, and environmental conservation, it will be understood that such elements must be regulated in the procedure, with a look at the Sustainable Development Goals, the global challenges of the project millennium, and to the thematic focuses Mission de sabios Colombia 2019.
