Living in an overcrowded prison can mean spending up to 23 hours a day in a single cell with 120 inmates but only 35 beds; inhaling secondhand smoke from "cellies" in a space invaded by cockroaches and ants; contracting skin diseases and fungal infections, among other things. Thus, human rights are instruments that every person has by virtue of their human dignity, they are completely inherent to the existence of the human being, that is, they are essential and permanent to the human being and cannot be separated from him because they are part of its nature and not depend on any external factor, which means that human dignity cannot be violated at any time.
The objective of this investigation was to analyze the incidence of prison overcrowding in the non guarantee of human rights in the event of non-compliance with international instruments on this matter ratified by Colombia, the national and international regulatory framework for the protection of human rights was defined. people confined in penitentiary centers, likewise, the relationship between overcrowding was analyzed as one of the causes of the violation of the human rights of people confined in penitentiary centers, to expose the main parameters that allow the guarantee of rights of the people confined in penitentiary centers since the reduction of this problem.
