The purpose of this project is to analyze how absenteeism due to certified medical incapacity of civilian personnel of the FAC Command impacts daily work processes. For this purpose, the procedure of action in cases of absences is established, based on normative and jurisprudential studies and how these provide special protection to workers who have a manifest weakness; since, health benefits such as reinforced labor stability are a legal tool used to keep workers in their occupations. In this paper a review is made of various pronouncements of the High Courts. The findings reveal that it is not possible to dismiss a worker with health protection without prior authorization from the Ministry of Labor or when exceptions apply. Also, the need to implement organizational strategies that impact the improvement of the organizational climate and the activities of health promotion and disease prevention to reduce the occurrence of diseases and accidents that generate absenteeism is exposed.
