A (in)constitucionalidade da reeleição sem limites no poder legislativo: o princípio republicano como valor fundamental para a renovação dos parlamentos brasileiros

O presente estudo busca aferir se a ausência de limites para a reeleição no âmbito do Poder Legislativo está em harmonia constitucional com o Princípio Republicano.
Como fundamentação teórica, estabelece-se a ideia segundo a qual ínsita à noção
de República, como forma de Governo adotada no Brasil, está a alternância de
poder e a renovação dos quadros políticos. Nessa linha de intelecção, procede-se a
uma análise das cláusulas pétreas explícitas e implícitas na Constituição Federal de
1988, bem como da relação que pode ser extraída entre a periodicidade do voto e o
Princípio Republicano, buscando a real essência do voto periódico. Além de
identificar se a ausência de limite para a reeleição no parlamento ofende a harmonia
constitucional da forma republicana de Governo, busca-se, ainda, construir uma
crítica incisiva que possa contribuir para elevar o grau de efetividade da participação
popular na disputa eleitoral, renovando os quadros políticos e permitindo, assim, o
surgimento de novas ideias e lideranças. Analisa-se a fixação de limites para essa
reeleição parlamentar em outros países e vislumbra-se, ao final, uma proposta mais
republicana para a realidade constitucional brasileira. The present study tries to verify if the absence of limits for the reelection in the scope of the Legislative Power is in constitutional harmony with the Republican Principle. As
a theoretical basis, the idea is established that, as part of the notion of the Republic,
as a form of government adopted in Brazil, there is the alternation of power and the
renewal of political frameworks. In this line of intellection, we proceed to an analysis
of the explicit clauses implicit in the Federal Constitution of 1988, as well as the
relationship that can be drawn between the periodicity of the vote and the Republican
Principle, seeking the real essence of the periodic vote. In addition to identifying
whether the absence of limits for re-election in parliament offends the constitutional
harmony of the Republican form of Government, it is also sought to construct an
incisive critique that can contribute to raise the degree of effectiveness of popular
participation in the electoral contest, the political frameworks and thus allowing the
emergence of new ideas and leadership. It is analyzed the setting of limits for this
parliamentary reelection in other countries, and in the end, a more republican
proposal for the Brazilian constitutional reality is seen.
