Liberdade de expressão e discurso de ódio: a proteção às minorias sociais perante a liberdade de expressão

O objetivo desse trabalho de conclusão de curso é realizar um estudo sobre as possíveis formas de limitação do direito à liberdade de expressão quando esta é utilizada para disseminação do discurso do ódio. Isso será feito através da verificação sobre o entendimento doutrinário e jurisprudencial quanto a colisão entre a liberdade para se expressar com a proteção ao princípio constitucional da dignidade da pessoa humana e direito à igualdade. Buscar compreender o que é o discurso de ódio enquanto fenômeno social, quais suas causas, em quais formas ele se manifesta, quais são os seus impactos, e o modo como vem se apresentando na sociedade atual através dos novos meios de comunicação, particularmente, através da internet e redes sociais. Finalmente, esse trabalho visa fazer uma breve comparação entre o tratamento do tema pelo ordenamento jurídico brasileiro e o a visão desse tema pela doutrina e jurisprudência da Alemanha e Estados Unidos. The objective of this work is to condute a study on possible ways of limiting the right of free speech when it is used to disseminate hate speech. This will be done through the verification of the doctrinal and jurisprudential understanding regarding the collision between the freedom of speech with the protection of the constitutional principle of the dignity of the human person and the right to equality. Seek to understand what the hate speech is as a social phenomenon, what its causes are, in what forms it manifests itself, what its impacts are, and how it is presented in today's society through the new media, particularly through the internet and social networks. Finally, this work aims to make a brief comparison between the treatment of the subject by the Brazilian legal system and the view of this subject by the doctrine and jurisprudence of Germany and the United States of America.
