This work aims to understand the principles of religious freedom and laity in the Rule of Law and its practical implications for the political participation of religious entities or leaders as brazilian amicus curiae in public hearings and the legal effect of their arguments for decisions of the Brazil’s Federal Supreme Court. To this end, the path of analysis of the relationship between the religious phenomenon, society and the State was followed; as well as the understanding of state laicity in the brazilian regime and its relationship with democratic political participation; and, finally, the study of the Supreme Court decisions. As a methodology, there were used the review of specialized literature, analysis of national and international legislation, and decisions of the Supreme Court, as well as the deductive method to verify how this Court has behaved in relation to the arguments of such entities and the reception of them when translated into public reasons. In the end, it is observed that The Brazil's Federal Supreme Court has privileged religious freedom through the opportunistic participation of such entities and religious leaders as brazilian amicus curiae in public hearings and that, despite this, the arguments of those representatives are not legally relevant to decisions, even when they do not impose dogma and are translated into public reasons. O presente trabalho tem por finalidade compreender os princípios da liberdade religiosa e da laicidade no Estado Democrático de Direito e suas implicações práticas na participação política de entidades ou líderes religiosos na qualidade de amicus curiae em audiências públicas e o efeito jurídico de seus argumentos para as decisões do Supremo Tribunal Federal. Para isso, percorreu-se o caminho da análise da relação existente entre o fenômeno religioso, a sociedade e o Estado; da compreensão da laicidade estatal no regime brasileiro e a sua relação com a participação política democrática; e, por fim, o estudo de decisões do STF. Como metodologia, utilizou-se a revisão bibliográfica de literatura especializada, análise de legislação nacional e internacional e de decisões da Suprema Corte, assim como o método dedutivo para verificar como essa tem se comportado em relação aos argumentos de tais pessoas e entidades e o acolhimento deles quando traduzidos em razões públicas. Ao final, constata-se que o STF tem privilegiado a liberdade religiosa por meio da oportunização da participação de tais entidades e líderes religiosos como amicus curiae naquela situação e que, apesar disso, os argumentos desses representantes não se mostram relevantes, juridicamente, para as decisões, mesmo quando não imponham dogma e estejam traduzidos em razões públicas.
