Cryptoassets are consolidating as a global trend, largely due to their easily acquisition provided by exchanges, which are known as cryptocurrency exchanges. This consolidation has brought with you many consequences, such as increased attention from governments, leading to greater regulation of the entire market involving these assets.. It was no different in Brazil, as with the advent of Law 14.478/2022, the country started regulating cryptoassets and exchanges, which may have several legal consequences for this market, particularly regarding the civil liability of cryptocurrency exchanges. The aforementioned legislation explicitly introduced the possibility of applying the Consumer Protection Code to hold these exchanges liable. However, the operation of these companies is not recent in Brazil, dating back well before the promulgation of the regulating law, reason why, it was necessary to investigate the mode of civil liability they were subject to prior to the advent of the law and which impacts that this law brought on such civil liability. Thus, aiming to achieve these answers, this study dedicated itself to conceptualizing cryptoassets and exchanges and then determining the system of civil liability that these companies were subject to before the advent of the regulating law and identifying the regulatory impacts this law caused in this regard. These objectives were achieved by creating hypotheses and subsequently confronting them with arguments until reaching the conclusion that cryptoassets exchanges were already subject to the application of the Consumer Protection Code prior to Law 14.478/2022 and that the new legislation consolidated existing understandings in part of the jurisprudence, thereby providing greater legal certainty, As well as indirectly influenced the civil liability of exchanges. Os criptoativos estão se consolidando como uma tendência mundial, muito em parte pela sua facilidade de aquisição proporcionada pelas corretoras desses ativos, conhecidas como exchanges. Essa consolidação trouxe consigo diversas consequências, tal como a maior atenção por parte de governos, gerando assim uma maior regulação de todo o mercado que envolve esses ativos. Isso não foi diferente com o Brasil, com o advento da lei 14.478/2022 o país passou a regular os criptoativos e as exchanges, fato que pode trazer diversas consequências jurídicas para esse mercado, em especial, no que diz respeito a responsabilidade civil das exchanges de criptoativos, dado que o aludido diploma trouxe expressamente consigo a possibilidade de que essa responsabilidade se dê por meio da aplicação do Código de Defesa do Consumidor. Todavia, o funcionamento dessas empresas não é recente no Brasil, remontando a bem antes da promulgação da lei que as regulamentaram, razão pela foi necessário investigar o modo de responsabilização civil que estavam sujeitas antes do advento da lei e quais os impactos que essa lei trouxe no tocante a essa responsabilização civil. Destarte, visando alcançar tais respostas, esse trabalho se dedicou a conceituar os criptoativos e as exchanges, para então determinar a sistemática de responsabilização civil que as aludidas empresas estavam sujeitas antes do advento da lei regulamentadora e identificar quais os impactos regulatórios essa lei causou nessa temática. O alcance desses objetivos foi possível pela criação de hipóteses e de sua posterior confrontação com argumentos até que se chegasse à conclusão de que as exchanges de criptoativos já estavam sujeitas a aplicação do Código de Defesa do Consumidor antes da lei 14.478/2022 e a de que a nova legislação consolidou entendimentos já existentes em parte da jurisprudência, proporcionando assim maior segurança jurídica, bem como interferiu de modo indireto na responsabilização civil das exchanges.
