The present study aims to analyze the participation of Civil Society (SC) in the management
of public sports policies, through the Sports Councils (CE's). This concern arises from the
question: how is SC's participation in the management of public sports policies? From
exploratory studies on doctoral theses in the last 5 years, it was noticed that there was only
one work that dealt with the participation of SC in public sports policies. Starting from two
central categories SC and social participation, it was noticed that they are permeated by other
categories, almost inseparably, they are: State, politics, democracy, and public policy of sports
that, in addition to the two initial categories, make up the theoretical framework to support the
discussion on the participation of SC in the management of sport, through the EC's. The
methodology used for the development of the work was an exploratory study and had as a
time frame from 1988 - having as a starting point the approval of the Federal Constitution from
1988 to the year 2018 - year of presentation of the study proposal. Thus, sport started in the
Federal Constitution of 1988, the infraconstitutional laws law nº 8.672/1993 and law nº
9.615/1998, which regulate the sport in Brazil, passing through the laws and decrees that
regulate the sport in the State of Paraná, culminating with the laws and decrees that institute
the EC's of the micro-region of Campos Gerais/Pr. In addition to these laws and decrees,
readings were made of the minutes, internal regulations and interviews about the participation
of its counselors, at the three levels of government, Federal, State and Municipal, through
semi-structured interviews. As for the analysis of the data, they were carried out in a qualitative
way, in which Habermas' thinking about democracy and deliberation was taken as a reference
for the ideal of participation. The study was organized into five chapters, the first and second
being theoretical foundations in which the basic categories and their concepts are worked on
in order to support the analysis of SC participation in EC's. The third addresses the
methodology used for the development of the research, classifying it as a study of deductive
characteristics that seek the similarities and differences between the EC's in all instances of
the Public Power in Brazil. In the fourth chapter, an overview of the Public Policy Councils and
EC's in Brazil, Paraná and in the Microregion of Campos Gerais/Pr. The fifth chapter presents
the research data and the analysis of SC's participation in the management of public sports in
the period 1988/2018. In the final considerations, the defense of the thesis is presented that
the EC's in Brazil failed to become an expression of democratization of SC's participation in
the management of public sports policies, since they performed functions and carried out
peripheral discussions on public sports policy, acting when much, as an organ of social control
of the management in the area, when it was allowed by the public power and, having as
reference the thinking of Habermas on deliberative participation, the study allows to affirm that
the processes of democratization/participation have not yet entered the area of public
management of sport and this perceives the participation with an intervention of society in an
area of technocratic knowledge, therefore, it is not welcome and therefore it comes up against
not doing, in the sense of expanding participation and power sharing, as a policy. O presente estudo tem por objetivo analisar a participação da Sociedade Civil (SC) na gestão
das políticas públicas de esportes, por meio do Conselhos de Esportes (CE’s). Tal inquietação
surge com a questão: como é a participação da SC na gestão das políticas públicas de
esportes? Percebeu-se, a partir de estudos exploratórios sobre teses de doutorado nos
últimos 5 anos, a existência de apenas um trabalho que versou sobre a participação da SC
nas políticas públicas de esporte. Partindo de duas categorias centrais, SC e participação
social, percebeu-se que as mesmas são permeadas por outras categorias, quase que de
maneira indissociável, sendo elas: estado, política, democracia e política pública de esportes
que, além das duas categorias iniciais, compõe o arcabouço teórico para fundamentar a
discussão sobre a participação da SC na gestão do esporte através dos CE’s. A metodologia
utilizada para o desenvolvimento do trabalho foi um estudo exploratório, e teve como recorte
temporal de 1988 – tendo como marco inicial a aprovação da Constituição Federal de 1988,
ao ano de 2018 – ano de apresentação da proposta do estudo. Assim partiu-se do esporte na
Constituição Federal de 1988, a leis infraconstitucionais, lei nº 8.672/1993 e lei nº 9.615/1998,
que regulamentam o esporte no Brasil, passando pelas leis e decretos que normatizam o
esporte no Estado do Paraná, e culminando com as leis e decretos que instituem os CE’s da
microrregião dos Campos Gerais/Pr. Além destas leis e decretos, foram feitas leituras das
atas, regimento interno e entrevistas sobre a participação de seu conselheiros, nos três níveis
de governo, Federal, Estadual e Municipal, através de entrevista semiestruturada. Quanto às
análises dos dados, foram feitas de maneira qualitativa, em que se tomou como referência de
ideal de participação o pensamento de Habermas a respeito de democracia e deliberação. O
estudo foi organizado em cinco capítulos, sendo o primeiro e o segundo capítulo de
fundamentação teórica no qual as categorias básicas e seus conceitos são trabalhadas de
forma a dar suporte a análise da participação da SC nos CE’s. O terceiro aborda a metodologia
utilizada para o desenvolvimento da pesquisa, classificando como um estudo de
características dedutivas que buscam as similaridades e afastamentos entre os CE’s em todas
as instâncias do Poder Público no Brasil. No quarto capítulo, traça-se um panorama dos
Conselhos de Políticas públicas e dos CE’s no Brasil, Paraná e na Microrregião dos Campos
Gerais/Pr. O quinto capítulo apresenta os dados da pesquisa e a análise da participação da
SC na gestão das públicas de esportes no período 1988/2018. Nas considerações finais,
apresenta-se a defesa da tese de que os CE’s no Brasil não conseguiram se tornar uma
expressão de democratização e participação da SC na gestão das políticas públicas de
esporte pois, desempenharam funções e realizaram discussões periféricas sobre a política
pública de esportes, atuando, quando muito, como um órgão de controle social da gestão na
área, quando lhe foi permitido pelo poder público. Tendo como referência o pensamento de
Habermas sobre participação deliberativa, o estudo permite afirmar que os processos de
democratização/participação ainda não adentraram a área da gestão pública do esporte, e
esta percebe a participação como uma intervenção da sociedade em uma área do saber
tecnocrático, e portanto, não é bem vinda e por isso esbarra no não fazer, no sentido de
ampliar a participação e a partilha do poder, enquanto uma política.
