Jurisdicción marítima en Panamá y alternativas de solución frente al secuestro marítimo decretado por la existencia de un proceso legal previo

Este trabajo de grado, esquematiza una situación en particular surgida en el desarrollo de las operaciones internacionales de comercio exterior en el canal de panamá. Los buques que de manera necesaria hacen tránsito por este importante conducto interoceánico están sujetos a ser revestidos por la jurisdicción de los tribunales marítimos de Panamá quienes en virtud de las prerrogativas y facultades que la ley les atribuye pueden aplicar medidas de tipo cautelar sobre los buques y mercancías en tránsito y solicitadas por personas naturales o jurídicas y cualquier tipo de sujeto con la capacidad de exigir el reconocimiento de derechos de crédito u obligaciones de pago expresas y claras.
Se realiza un resumen detallado de la historia de las operaciones de comercio exterior en Latinoamérica y su relación con el derecho procesal marítimo, los criterios para atribuir competencia a este tribunal y las medidas cautelares legal y comercialmente existentes para intentar garantizar una tutela judicial efectiva de derechos de crédito, y los sobrecostos operativos que estas mismas generan a las partes interesadas; terminando con alternativas de solución de conflicto para las pretensiones de carácter económico iniciadas en jurisdicción panameña y las respetivas conclusiones, en donde se hará énfasis en la importancia que reviste el conocimiento de esta temática para los profesionales en comercio exterior en Latinoamérica. This work of degree, it outlines a situation especially arisen in the development of the international operations of exterior trade in the channel of panama hat. There is realized a detailed summary of the history of the operations of exterior trade in Latin America and his relation by the maritime procedural law, the criteria to attribute competition to this court and the measures you will protect legal and commercial existing to try to guarantee a judicial effective guardianship of credit rights, and the operative extra charges that these themselves generate to the interested parts; finishing with alternatives of solution of conflict for the pretensions of economic character initiated in Panamanian jurisdiction and the respectives conclusions, where emphasis will be done in the importance that re-dresses the knowledge of this subject matter for the professionals in exterior trade in Latin America.
