La judicialización de los derechos : una mirada a sus riesgos y desafíos

RESUMEN: Este trabajo describe los riesgos y desafíos que se advierten desde la teoría de la democracia deliberativa sobre el rol protagónico de los jueces en Latinoamérica y en Colombia para la solución de los conflictos sociales, especialmente aquellos relacionados con el carácter sustantivo de la democracia, fenómeno que se ha denominado como judicialización de la política y activismo judicial. Es decir, este trabajo se inscribe en las discusiones contemporáneas del derecho constitucional sobre el papel del juez en la consolidación de la democracia, para lo cual se construye un marco teórico desde la concepción deliberativa que permite específicamente plantear problematizaciones sobre la categoría de judicialización de la política, para lo cual se acude al ejemplo de la discusión sobre la actividad minera en Colombia y se propone acercar mecanismos dialógicos al control constitucional.
