Resumen
En el presente artículo se aborda la problemática relacionada con la Ley de Restitución de Tierras, que forma parte del Sistema Nacional de Atención y Reparación Integral a las Víctimas, ya que el Principio de Celeridad que en Colombia se invoca con la finalidad de lograr que los procesos administrativos, contenciosos y procesales resulten ágiles para con ello evitar que se vulneren los principios y derechos de las víctimas, no se ha podido conseguir en el proceso de restitución de predios que hubieran sido despojados violentamente en medio del muy amplio y dilatado proceso de violencia interna del país.
Resulta extraño que, en Colombia, el Consejo Nacional de Política Económica y Social se haya manifestado en concordancia con la aplicación de sistemas electrónicos que pudieran establecer las bases de lo que en su momento podría llegar hacer la inteligencia artificial (AI) aplicada a los procesos judiciales tanto en el Documento CONPES 3920 como en el Documento CONPES 3975, y la resolución de la problemática inherente a la restitución de predios siga sin atender al Principio de Celeridad en el Sistema Judicial Colombiano y que no haya sido aplicable al Sistema Nacional de Atención y Reparación Integral a las Víctimas y a la Ley de Restitución de Tierras, pero la aplicación de la Inteligencia Artificial (AI) no podrá iniciarse mientras no exista un catastro confiable que permita determinar cuál es la identidad real de los verdaderos y originales propietarios y tenedores de muchos predios This article addresses the problem related to the Land Restitution Law, which is part of the National System of Attention and Comprehensive Reparation to Victims, since the Principle of Speed that is invoked in Colombia in order to ensure that the administrative, contentious and procedural processes are agile in order to avoid violating the principles and rights of the victims, it has not been possible to achieve in the process of restitution of properties that had been violently dispossessed in the midst of the very wide and lengthy process of violence internal country.
