Regulación de los delitos contra la propiedad Intelectual en Colombia y su necesidad para la protección de los signos distintivos, nuevas creaciones y las obras artísticas, científicas y literarias

Abstract

The purpose of this paper is to determine the scope and sufficiency of the current civil regulation of intellectual property in Colombia, asking whether it is necessary to have a broader criminal approach to overcome the challenges faced by this matter in today's society. For this purpose, we will begin by describing the creations that are protected by the mechanisms provided by intellectual property in Colombia from the scope of private law. Additionally, we will discuss the protection mechanisms provided by private law to intellectual property rights. Then, we will delimit which are the legal properties that are protected in these cases, to later analyze the crimes against intellectual property in Colombia (sections 270-272 and 306-308 of the Criminal Code), and finally to identify whether or not protection is necessary and, if so what are the shortcomings of the Colombian legal system in this regard.

Additionally, we will identify the legal challenges that exist in the regulation of intellectual property in Colombia, both from the private and criminal law spheres, in order to propose possible solutions to these challenges.
