dc.description.abstractThis article analyzes the requirement of foreseeability of contractual damage in Colombia and England, legal systems in which this figure originated simultaneously in the 19th century based on the ideas of the French scholar Robert Joseph Pothier. From these, in England there was a great development and evolution of the figure, both in the academy and in jurisprudence, while in Colombia, on the contrary, not only has it not been developed, but it was relegated to a secondary role. doctrinally and jurisprudentially.
