Resumen
Se desarrolla una línea jurisprudencial de las decisiones judiciales del Consejo de Estado Colombiano en materia de responsabilidad médica obstétrica respecto del título de imputación aplicable y los elementos estructurantes de la misma. Se delimita fácticamente a los casos de complicaciones del embarazo previas al parto y el daño antijurídico que se ocasiona a la madre o a su hijo en el alumbramiento.
Se encuentra que el régimen aplicable, frente a los casos fácticamente delimitados, es el subjetivo con fundamento en la falla probada del servicio, por lo que cuando se produzca un daño por las lesiones o la muerte de la madre o el hijo o de ambos, con ocasión del parto, se deberá acreditar que el mismo fue causado por dicha falla; correlativamente la entidad demandada podrá exonerarse si logra demostrar que ésta no existió, que su actuación cumplió la Lex Artis Ad hoc.
