Análisis de la Inaplicabilidad de la Legítima Defensa en Ecuador

Abstract

El Ecuador es un Estado inmerso en derechos y justicia social, con base a este propósito, las normas crean un mecanismo de control regular que determina la convivencia conjunta con normas, decretos y prohibiciones tomando en cuenta el bienestar de la sociedad. Las causas de justificación son circunstancias que excluyen la antijuricidad, estas ocurren cuando existe una ponderación de derechos, lo cual genera un interés que procede a mantener una colisión entre la antijuricidad y la ilicitud sobre la conducta penalmente relevante afectando al bien jurídico. En el presente trabajo investigativo, se realizará un estudio minucioso y detallado de la legítima defensa y como procede su inaplicabilidad, esta causa de justificación tiene como mera finalidad proteger el bien jurídico de la agresión actual, con base a su procedimiento y su correcta utilización con base a la norma penal. Dentro de esta investigación la cual para simple recordatorio es de suma importancia en la actualidad, se centrará en el debido proceso de esta causa de justificación, es decir, como surge una determinada conducta atípica a cumplir con unos requisitos establecidos en la norma penal para poder ser catalogado como legítima defensa, como: agresión actual e ilegítima, necesidad racional de la defensa y falta de provocación suficiente por parte de quien actúa en defensa del derecho.

In the present investigation, a thorough and detailed study of the legitimate defense and its inapplicability will be carried out, this cause of justification has the sole purpose of protecting the legal good of the current aggression, on the basis of its procedure and its correct use on the basis of the criminal law. Within this investigation which for simple reminder is paramount at present, will focus on the due process of this cause of justification, that is, as a certain atypical conduct arises to comply with the requirements established in the penal norm in order to be classified as self-defence, as: present and illegitimate aggression, the rational need for defence and the lack of sufficient provocation on the part of those who act in defence of the law.
