Análisis de Constitucionalidad de Declaratoria de Estado de Excepción en la Función Judicial

En Ecuador, la declaratoria de Estado de Excepción es una medida excepcional que
permite al gobierno tomar acciones inmediatas para garantizar la seguridad y el
bienestar de la población. Esta medida se encuentra regulada en la Constitución de la
República, se pueden suspender ciertos derechos y garantías constitucionales, como la
libertad de circulación, la inviolabilidad de la vivienda y la libertad de asociación, entre
otros, la presente investigación tiene como finalidad analizar constitucionalidad de
declaratoria de Estado de Excepción en la Función Judicial, para ello se tiene como
revisión metodológica en análisis del Decreto Ejecutivo 872 y el dictamen 008-11-DEECC de la Corte Constitucional, que si bien este decreto fue declarado constitucional por
parte de los magistrados, fueron observado a través de los votos salvados. In Ecuador, the declaration of a State of Exception is an exceptional measure that allows
the government to take immediate action to guarantee the safety and well-being of the
population. This measure is regulated in the Constitution of the Republic, certain
constitutional rights and guarantees can be suspended, such as freedom of movement,
the inviolability of housing and freedom of association, among others, the purpose of
this investigation is to analyze the constitutionality of declaration of a State of Exception
in the Judicial Function, for this purpose, the methodological review is based on the
analysis of Executive Decree 872 and opinion 008-11-DEE-CC of the Constitutional Court,
which although this decree was declared constitutional by the magistrates, were
observed through the votes saved
