Resumen
El presente trabajo tiene como objetivo general de investigación Demostrar las afectaciones que se producen al principio del interés del niño por la falta de legislación de la figura jurídica de la tenencia compartida, es una de las áreas que surge de la parte de la Regulación Social, teniendo como fuente principal a la familia, que resulta de la asociación más esencial que existe en el planeta, que es el matrimonio, que ha fluctuado a lo largo de las épocas y de los escenarios sociales, es en este espacio donde se origina la figura jurídica de tenencia. Actualmente en la legislación ecuatoriana, el tipo de tenencia que nos regimos es la denominada tenencia uniparental, en el cual se otorga la tutela a uno de los progenitores quien se encargara de la convivencia habitual del menor, de esta manera el niño o la niña se encuentra Privada de compartir de igualdad de condiciones ya sea con el padre o la madre es decir que esto vulnera el interés superior del niño. The general objective of this work is to demonstrate the effects on the principle of the child's interest due to the lack of legislation of the legal figure of shared custody, which is one of the areas that arises from the Social Regulation, having as main source the family, which results from the most essential association that exists on the planet, which is marriage, which has fluctuated throughout the ages and social scenarios, it is in this space where the legal figure of custody originates. Currently in the Ecuadorian legislation, the type of custody that we are governed by is the so-called uniparental custody, in which the guardianship is granted to one of the parents who will be responsible for the usual cohabitation of the child, in this way the child is deprived of sharing equal conditions with either the father or the mother, that is to say that this violates the best interests of the child.
