Incorporación del control previo por parte de la Procuraduría General del Estado en los contratos a ser celebrados por las entidades del sector público.

Resumen
En el año dos mil ocho se le retiró a la Procuraduría General del Estado (en
adelante PGE) la facultad que poseía de realizar los controles de legalidad antes de la
suscripción de un contrato que iba a ser celebrado por cualquier entidad del Estado;
consecuencia de esto, hoy en día es muy palpable ver los altos índices de casos de
corrupción que se han venido dando en las contrataciones que ha realizado el Estado
ecuatoriano por medio de sus instituciones.
El diecisiete de febrero del año dos mil veintiuno, se reformó la Ley que regula la
Contratación Pública (en adelante LOSNCP) y trajo consigo una nueva atribución a la
Contraloría General del Estado (en adelante CGE), la de emitir los informes de
pertinencia y favorabilidad, pese a esta nueva función añadida a la CGE aún sigue
siendo insuficiente el control que debe ser realizado a las contrataciones públicas, pero
¿Por qué sigue siendo ineficiente el control que actualmente realiza la CGE a las
contrataciones públicas?, simple, porque la entidad de control solo se limita a analizar si
la entidad que requiere contratar un servicio, producto, obras, etc., cumple o no con los
requisitos estipulados en el Art. 61 del Reglamento a la LOSNCP.
Los recursos provenientes del Estado deben ser celosamente cuidados; por lo
tanto, es necesario aumentar los controles que actualmente se realiza a los procesos de
contratación de las Entidades del sector público. In the year two thousand and eight, the State Attorney General's Office

On February 17, 2021, the Law regulating Public Procurement (hereinafter
LOSNCP) was amended and brought with it a new attribution to the General State
Comptroller's Office (hereinafter CGE), that of issuing pertinent reports and
favourability, despite this new function added to the CGE, the control that must be
carried out on public contracting is still insufficient, but why does the control that the
CGE currently carries out on public contracting continue to be inefficient? Simple,
because the control entity is only limited to analyzing whether or not the entity that
requires contracting a service, product, works, etc., complies with the requirements
stipulated in Article 61 of the LOSNCP Regulation.
Resources from the State must be carefully guarded; therefore, it is necessary to
increase the controls that are currently carried out on the contracting processes of
public sector entities.
