Regulaciones de las penalidades en materia de viviendas de interés social.

Resumen
Los proyectos habitacionales de Vivienda de Interés Social, tal como lo
indica su denominación, son encaminadas a ofrecer una vivienda digna a
personas de escasos recursos, quienes -debido a su situación
socioeconómica- no han podido acceder a la Compraventa de una vivienda
como lo haría una persona con ingresos estables y suficientes; no obstante,
para poder acceder a estos proyectos inmobiliarios es necesario calificarse
como beneficiario de la mismo ante la institución correspondiente; una vez
que el comprador toma contacto con la promotora encargada del proyecto,
este debe cumplir con una serie de requisitos, entre esos la suscripción de
un Contrato de Promesa de Compraventa en el que se incluye plazos a
cumplir, y los posibles escenarios por los que podrían atrasarse las entregas
de las obras. Esta situación genera una desprotección de los derechos de
estas personas, quienes se enfrentan a una situación desigual debido al
poder adquisitivo de la promotora y la imposición de condiciones que, en
muchas ocasiones, son imposibles de cumplir, dando un paso al costado
respecto de la adquisición de la vivienda, además de tener que resolver
posibles controversias debido a lo que, a simple vista, es un incumplimiento de contrato. Social interest housing projects, as indicated by their name, are aimed at

socioeconomic situation- have not been able to access the purchase and
sale of a home as it would be a person with stable and sufficient income;
However, in order to access these real estate projects, it is necessary to
qualify as a beneficiary of the same before the corresponding institution;
Once the buyer makes contact with the promoter in charge of the project, he
must comply with a series of requirements, including the signing of a promise
of sale contract that includes deadlines to be met and the possible reasons
why they could late deliveries of works. This situation generates a lack of
protection of the rights of these people, who face an unequal situation due to
the purchasing power of the promoter and the imposition of conditions that,
on many occasions, are impossible to comply with, giving a step aside with
respect to the acquisition of the house, in addition to having to resolve
possible controversies due to what, at first sight, is a breach of contract.
