dc.description | La prueba, siendo una herramienta que permita develar la verdad de los hechos, actos
o afirmaciones en un proceso judicial, ha estado en continuo desarrollo con respecto
a sus nociones, conceptualizaciones, mismas que se separan entre su desarrollo en
relación a la verdad y su desarrollo como instrumento para la resolución práctica,
rápida y favorable del conflicto; y, más que nada, de su tratamiento en el juicio. Los
sistemas de valoración de la prueba sujetos a la consideración del legislador con la
prueba legal o la consideración del juez con la sana crítica, prestan criterios muy
marcados para la utilización de las pruebas en el proceso. La prueba, al ponerse en
duda su legitimidad, podría estar sujeta a transgresiones de derechos fundamentales
por los medios utilizados para su obtención, mismas que la catalogarían como ilícita,
pero no necesariamente ilegal. La doctrina y la jurisprudencia muestran numerosas
posturas en cuanto al tratamiento de pruebas de carácter ilícito, al punto de
desarrollarse dos modelos principales realmente importantes, como lo son el
norteamericano y el europeo. A raíz de esto, se fueron abriendo paso las reglas de
exclusión, mismas que pondrían una barrera en el tratamiento de pruebas ilícitas. Sin
embargo, este solo fue el detonante para que los juristas encontraran problemas sin
resolver, problemas que giraban en torno a las pruebas que se derivasen de aquellas
pruebas declaradas ilícitas, marcando así el posterior y necesario desarrollo de los
criterios de excepción a la regla de exclusión probatoria. | |
dc.description | The evidence, being a tool that allows the truth of the facts to be revealed, acts or
affirmations in a judicial process, have been a continuous development with respect
to its notions, conceptualizations, the same that are separated between its
development in relation to the truth and its development as an instrument for the
practice, rapid and favorable resolution of the conflict; and, more than anything, of
its treatment in the trial. The systems of evaluation of the evidence subject to the
consideration of the legislator with the legal evidence or the consideration of the
judge with the sound criticism, lend very marked criteria for the use of the evidence
in the process. When the evidence of the legitimacy is being questioned, it could be
subject to transgressions of fundamental rights by the means used to obtain it, which
would classify it as illicit, but not necessarily illegal. The doctrine and jurisprudence
show numerous positions regarding the treatment of evidence of an illicit nature, to
the point of developing two really important main models, such as the North
American and the European. As a result, the rules of exclusion were opening up,
which would put a barrier in the treatment of illicit evidence. However, this was only
the trigger for jurists to find unresolved problems, problems that revolved around the
evidence derived from the tests declared illegal, thus marking the subsequent and
necessary development of the criteria of exception to the rule of evidentiary
