Resumen
El Estado ecuatoriano a través de la promulgación de la Constitución de 2008 ha impulsado
un modelo de descentralización y de autonomía constituido por los Gobiernos Autónomos
Descentralizados (GAD). Estas formas de gobierno tienen independencia política,
administrativa y financiera respecto del Estado central. El problema de esta investigación
consiste en analizar el régimen de competencias constitucional de los GAD, su
efectivización en materia de políticas públicas y su grado de autonomía frente al Estado
central. En consecuencia, el objetivo de esta investigación es describir el marco normativo
constitucional y legislativo que fundamenta la autonomía de los GAD como parte de un
régimen jurídico que apunta al desarrollo social a través de políticas públicas locales
efectivos y sus relaciones normativo institucionales con el Gobierno central. De tal
manera, se cumple con el objetivo de este trabajo a través del análisis de este problema,
además de comprender que la solución pertinente está en el régimen de competencias de la
Constitución y el COOTAD. En consecuencia, los resultados de este trabajo se han
conseguido metodológicamente desde la perspectiva de los criterios aportados por la
doctrina, las normas constitucionales y legales para el análisis de la problemática abordada.
Por lo tanto, el enfoque predominante es el cualitativo debido al predominio de la doctrina
y las normas jurídicas que son recursos suficientes para delimitar el problema jurídico
constitucional, reconocerlo y solucionarlo. Como resultado de esta investigación
concluimos que existe un régimen de competencias constituido por los GAD, los cuales se
ven protegidos del intervencionismo del Estado central a través de la cláusula de autonomía
del COOTAD que protege sus funciones. The Ecuadorian State through the promulgation of the 2008 Constitution has promoted a
model of decentralization and autonomy constituted by the Decentralized Autonomous
Governments (GAD). These forms of government have political, administrative and
financial independence from the central state. The problem of this research is to analyze the
regime of constitutional powers of the GADs, their implementation in terms of public
policies and their degree of autonomy from the central State. Consequently, the objective of
this research is to describe the constitutional and legislative normative framework that
bases the autonomy of the GADs as part of a legal regime that aims at social development
through effective local public policies and their normative-institutional relations with the
central government. . In this way, the objective of this work is fulfilled through the analysis
of this problem, in addition to understanding that the pertinent solution is in the regime of
competences of the Constitution and COOTAD. Consequently, the results of this work
have been obtained methodologically from the perspective of the criteria provided by the
doctrine, the constitutional and legal norms for the analysis of the problem addressed.
Therefore, the predominant approach is the qualitative one due to the predominance of the
doctrine and legal norms that are sufficient resources to define the constitutional legal
problem, recognize it and solve it. As a result of this investigation, we conclude that there is
a system of powers constituted by the GADs, which are protected from the interventionism
of the central State through the COOTAD autonomy clause that protects their functions.
