Ineficacia de las providencias preventivas en el Código Orgánico General de Procesos.

Resumen
El derecho a la tutela judicial efectiva es un derecho fundamental procesal que permite
a toda persona acceder ante el órgano jurisdiccional para solicitar la protección de sus
derechos, con la finalidad de evitar o cesar la amenaza o violación de sus derechos. Para
asegurar el cumplimiento y efectividad de dicho derecho fundamental es importante que se
garantice el cumplimiento de la tutela cautelar, la cual es una medida de respuesta frente al
peligro del daño que la demora de un proceso podría ocasionar sobre el derecho que se discute,
garantizando así la efectividad de las resoluciones. Este derecho se materializa a través de
medidas cautelares idóneas, y no se debería restringir su ámbito de aplicación a tipos de
medidas cautelares taxativas. El ordenamiento jurídico ecuatoriano prevé en el Código
Orgánico General de Procesos providencias preventivas tipificadas de manera taxativa,
estableciendo requisitos para la justificación de su procedencia. Sin embargo, la regulación de
dichas providencias preventivas se encuentra tipificadas, pues el efecto de esta hace alusión a
una tutela preventiva y no una la tutela cautelar, lo cual es imperativo modificar y esclarecer. The right to effective judicial protection is a fundamental procedural right that allows
everyone to access the jurisdictional body to request the protection of their rights, in order to
avoid or cease the threat or violation of their rights. To ensure compliance and effectiveness
of said fundamental right, it is important to guarantee compliance with precautionary
protection, which is a response measure against the danger of damage that the delay of a
process could cause on the right that is discussed, thus guaranteeing the effectiveness of
resolutions. This right materializes through appropriate precautionary measures, and its scope
of application should not be restricted to specific types of precautionary measures. The
Ecuadorian legal system provides in the General Organic Code of Processes, preventive
measures typified in an exhaustive manner, establishing requirements for the justification of
their origin. However, the regulation of said preventive orders is typified, since the effect of
this alludes to a preventive guardianship and not a precautionary guardianship, which is
imperative to modify and clarify.
