El abuso del derecho a la libertad con la garantía jurisdiccional de Hábeas Corpus en el Ecuador.

Resumen
La libertad constituye un derecho primordial de las personas; por lo que, el ser privada de ella
en situaciones ilegales, ya que atentan a los atributos autónomos que deben ser reconocidos y
protegidos por el Estado por ser derechos subjetivos que emanan de la dignidad humana y que
la resguardan. El medio idóneo para que el ser humano privado de su libertad de forma ilegal
o arbitraria es mediante un Hábeas Corpus, recurso que desde sus comienzos ha demostrado
ser un recurso eficaz y rápido, dicho recurso , desde sus comienzos ha significado un
mecanismo esencial para el derecho y para las personas, que fueron privadas de su libertad; ya
que, con la presentación de este recurso se busca que la persona comparezca en la audiencia y
así se pueda determinar si su detención cumplió con los parámetros establecidos dentro de la
ley.
La acción del Hábeas Corpus se genera como medio de tutela de la libertad personal por sufrir
alguna vulneración, su objetivo es corregir la ilegalidad que se puede generar en la privación
de la libertad de una persona, la característica de esta garantía es la rapidez y efectividad
representada como una vía adecuada e idónea para evitar o remediar alguna arbitrariedad o
vulneración de la libertad personal.
Con la vigencia de la nueva Constitución de la República del Ecuador aprobada en el año 2008,
en el Art. 86 numeral 2 menciona que a través del conocimiento y resolución del Hábeas
Corpus se encamina a que el juez o jueza competente es el del lugar donde se comete el acto
u omisión o donde se producen sus efectos. Sin embargo, en este estudio se presenta un análisis
jurídico de cómo en el Ecuador esta acción de garantía jurisdiccional está siendo abusada
ilegítimamente para beneficiar a personas con alto poder político. Freedom constitutes a fundamental right of people; therefore, being deprived of it in illegal
situations, since they violate the autonomous attributes that must be recognized and protected
by the State as subjective rights that emanate from human dignity and protect it. The ideal
means for the person who has been illegally or arbitrarily deprived of their liberty is through
Habeas Corpus, a remedy that from its beginnings has come to be an effective and rapid
remedy, said remedy, from its beginnings, has meant an essential mechanism for the law and
for the people, who were deprived of their liberty; since, with the presentation of this resource,
it is sought that the person appear at the hearing and thus it can be determined if her detention
of her complied with the parameters established within the law.
The habeas corpus action is generated as a means of protecting personal liberty due to suffering
some violation, its objective is to correct the illegality that can be generated in the deprivation
of liberty of a person, the characteristic of this guarantee is the speed and effectiveness
represented as an adequate and suitable way to avoid or remedy any arbitrariness or violation
of personal freedom.
With the validity of the new Constitution of the Republic of Ecuador approved in 2008, in Art.
86 numeral 2 mentions that through the knowledge and resolution of Habeas Corpus it is
directed that the competent judge or judge is the one of the place where the act or omission is
committed or where its effects are produced. However, this study presents a legal analysis of
how in Ecuador this jurisdictional guarantee action is being illegitimately abused to benefit
people with high political power.
