La reparación integral en casos de graves violaciones de derechos humanos en el Ecuador, caso Guzmán Albarracín vs Ecuador.

Resumen
La reparación integral es un mecanismo jurídico que busca restablecer el daño
ocasionado volviendo a su estado natural de ser posible o satisfacer de alguna
forma el daño sufrido, desde este enfoque el tema de estudio tiene como objetivo
principal determinar qué reparar en el caso de vulneraciones a los derechos a la
integridad física, psicológica y sexual; al efecto se analiza de manera crítica y
jurídica el Caso Guzmán Albarracín vs Ecuador, siendo la primera sentencia
emitida por la Corte Interamericana de Derechos Humanos sobre violencia sexual
en instituciones educativas, cuya problemática tiene que ver con la violación
sexual en entidades educativas y el mecanismo de reparación más eficaz y
compensatorio; siendo pertinente investigar a fin de reforzar los conocimientos
adquiridos y aportar nuevos conocimientos en función de establecer los
parámetros esenciales que conlleva una reparación efectiva en estos casos.
Objetivos programados, se tendrá que analizar de ser necesario sentencias de la
Corte Interamericana de Derechos Humanos para alcanzar el objetivo planteado;
motivo por el cual, se realiza una investigación cualitativa con enfoque
descriptivo y analítico sobre los parámetros jurisprudenciales señalados para la
reparación integral; se aplica la técnica de la revisión bibliográfica y se usa el
instrumento de análisis documental para desarrollar el tema escogido cuya
información será validada y debatida a fin de obtener resultados positivos que
permitan emitir conclusiones sobre la importancia de la reparación por
violaciones de derechos fundamentales como la integridad personal de las niñas y
adolescentes en el ámbito educativo ante daños severos e irreparables ocasionados
tanto a la víctima directamente y a sus familiares indirectamente, dado el abuso y
acoso sexual que sufrió la víctima. Comprehensive reparation is a legal mechanism that seeks to restore the damage
caused by returning to its natural state if possible or satisfy in some way the
damage suffered, from this approach the subject of study has as its main objective
to determine what to repair in the case of violations of the rights to physical,
psychological and sexual integrity; To this end, the case of Guzmán Albarracín vs.
Ecuador is critically and legally analyzed, being the first sentence issued by the
Inter-American Court of Human Rights on sexual violence in educational
institutions, whose problem has to do with sexual violation in educational entities
and the mechanism more effective repair and compensatory; It is pertinent to
investigate in order to reinforce the knowledge acquired and contribute new
knowledge in order to establish the essential parameters that an effective repair
entails in these cases. Programmed objectives, judgments of the Inter-American
Court of Human Rights will have to be analyzed if necessary to achieve the stated
objective; reason for which, a qualitative research is carried out with a descriptive
and analytical approach on the jurisprudential parameters indicated for
comprehensive reparation; the bibliographic review technique is applied and the
documentary analysis instrument is used to develop the chosen topic whose
information will be validated and debated in order to obtain positive results that
allow conclusions to be drawn on the importance of reparation for violations of
fundamental rights such as personal integrity of girls and adolescents in the
educational field in the face of severe and irreparable damage caused both to the
victim directly and to their relatives indirectly, given the abuse and sexual
harassment suffered by the victim.
