Potestad revisora, discrecionalidad y seguridad jurídica.

Resumen
El presente trabajo de investigación tiene como fin analizar la potestad revisora de la
Administración Pública, contrastando su posible ejercicio discrecional y posibilidad
de prescripción, con los principios de seguridad jurídica, interés general y legalidad,
los cuales están garantizados por la Constitución de la República del Ecuador. Para
esto se ha realizado un estudio del concepto de las potestades públicas y sus fines en
la normativa ecuatoriana. Seguido de un breve análisis de la autotutela administrativa,
con lo que se deja en claro el poder que tiene la Administración Pública para hacer
justicia por sí sola. Se incluye también, como parte del análisis, el concepto del acto
administrativo válido, así como su teoría de invalidez, con lo que se esclarece que tipo
de actos pueden ser objeto de la potestad revisora. Se continúa analizando las posibles
afectaciones, que la aplicación de esta potestad, causaría a los principios arriba
mencionados, en virtud de su ejercicio discrecional, y su posibilidad de prescribir. Por
último, se concluye que, en la aplicación de esta facultad es necesario buscar el
equilibrio de todos los derechos y principios que involucra, así como también es
necesario que exista desarrollo jurisprudencial que aclare los límites de su uso. The purpose of this research paper is to analyze the reviewing power of the Public
Administration, contrasting its possible discretionary exercise and possibility of a
limitation act, with the principles of legal certainty, general interest and legality, all of
which are guaranteed by Ecuador’s Constitution. In order to achieve this, first, a study
about the concept of public powers in Ecuador’s legal framework is done. Followed
by a brief analysis of the Public Administration’s self-executing decision-making
powers, that clarifies the power that the Administration has in order to self-govern. It
is also included, as a part of the analysis, the concept of the administrative acts, as well
of their theory of invalidity, which makes clear the type of acts that can be subject to
the reviewing power. It is continued by the analysis of the possible effects that the
application of this power would cause to the above-mentioned principles, because of
its discretionary exercise, and the possibility of a limitation act. Finally, the conclusion
states that, in the application of this power, it is necessary to seek the balance between
all the rights and principles involved, and, the development of jurisprudence that
defines the limits of its use, is also necessary.
