Resumen
El objeto del presente trabajo de titulación se encarga de analizar el fenómeno de la
estandarización contractual dentro de la contratación masiva del sistema privado, sus posibles
implicancias, de carácter irregular, para luego abordar la figura de las asociaciones de
consumidores como alternativa frente a estos posibles abusos de poder. Para ello, abordaremos
inicialmente con los antecedentes pertinentes al caso. Asimismo, el desarrollo de los elementos
que integran la teoría del contrato. Como lo ha demostrado la historia, la travesía de nuestro
Derecho Privado ostenta como piedra angular a los contratos. Sin la contratación, el proceso en
el intercambio de bienes y servicios de las sociedades se traduciría en operaciones inestables y
tardías. Sin embargo, como sabemos, el dinamismo en el Derecho ha sido uno de sus rasgos
más distintivos, lo cual ha traído consigo la aparición de nuevas instituciones como respuesta a
los fenómenos que van surgiendo, uno de ellos la contratación masiva. La necesidad e
importancia en realizar el siguiente trabajo radica en llevar una inspección del marco normativo
para la defensa de los consumidores, específicamente una figura idónea, pero poco usada en el
Derecho Privado para atenuar los posibles abusos surgidos de este fenómeno analizado
previamente. Abusos que derivan del otorgamiento a una de las partes contractuales para
determinar el contenido de una relación jurídica. The purpose of this thesis is to analyze the phenomenon of contractual standardization within
the mass contracting of the private system, it’s possible negative implications, with emphasis
on contracts, and then to address the figure of consumer associations as an alternative to these
possible abuses of power. For this purpose, we will initially deal with the relevant background
of the case. Also, the development of the elements that make up the contract theory. As history
has shown, the journey of our Private Law has contracts as its cornerstone. Without contracting,
the process in the exchange of goods and services of societies would result in unstable and
delayed operations. However, as we know, dynamism in Law has been one of its most
distinctive features, which has brought about the appearance of new institutions as a response
to emerging phenomena, one of them being mass contracting. The need for and importance of
the following work lies in carrying out an inspection of the regulatory framework for the
defense of consumers, specifically a suitable figure in Private Law to mitigate the possible
abuses arising from this phenomenon previously analyzed. Abuses arising from the granting to
one of the contractual parties to determine the content of a legal relationship.
