Vacío legal sobre la “No Consignación del Valor Ofrecido” del artículo 408 del COGEP.

Resumen
El derecho al ser una ciencia cuya estructura se modifica
constantemente debido a múltiples variantes, entre estas el cambio social,
optimización, avances tecnológicos, etc., tenemos la obligación de mantenerla
actualizada y de normarla de forma que no solo sea eficiente, si no que se
prevea toda circunstancia en la que el derecho sea vulnerado. El presente
trabajo está enfocado en la revisión del artículo 408 del Código Orgánico
Genera de Procesos, en búsqueda de aclarar, determinar y estructurar de
manera correcta el vacío legal que se encuentra redactado en el artículo
previamente mencionado. Esto debido a que la deficiente normativa sobre el
remate provoca la incertidumbre legal sobre qué sucederá con el remate en
sí, ante la No consignación del valor ofrecido por parte todas las posturas
presentadas; abriendo las puertas a circunstancias no contempladas en la
ley, que consecuentemente pueden ser utilizadas para manipular el proceso
de remate. Por lo tanto, no es debido únicamente al constante desarrollo que
tiene el derecho si no a la intrínseca necesidad de justicia, control social y un
correcto funcionamiento del derecho que nos obliga a la búsqueda de un
cuerpo normativo completo, sin falencias para evitar así el uso inapropiado de
las leyes; y encontrar armonía en ellas. The law is a science whose structure modifies constantly due to multiple
variants, among them social change, optimization, technological advances,
etc., we have the obligation to keep it updated and to regulate it in a way that
is not only efficient, but that any circumstance in which the right is violated is
foreseen. This work is focused on the revision of article 408 of the General
Organic Code of Processes, in pursue of clarifying, determining and correctly
structuring the legal vacuum that is drafted in the previously mentioned article.
This is because the deficient regulation on the auction causes legal uncertainty
about what will happen to the auction itself, after the non-consignment of the
value offered by all the positions presented; opening the doors to
circumstances not contemplated in the law, which consequently can be used
to manipulate the auction process. Therefore, it is not only due to the constant
development that the law has, but also to the intrinsic need for justice, social
control, and a correct functioning of it that obliges us to search for a complete
normative body, without shortcomings to avoid the inappropriate use of laws;
and find harmony in them.
