El objetivo general de este examen trabajo de complexivo es el de analizar las responsabilidades de todo tipo (penal, civil, administrativo, etc.) que tiene un notario al celebrar un acto correspondiente a su labor diaria como fedatario público. Se ha revisado la normativa legal vigente para así establecer no solo cuáles son las responsabilidades del notario público, sino también, para llegar a un análisis profundo en cual se establecerá si el incumplimiento de ciertas formalidades como la recaudación y/o pago de los servicios notariales acarrea sanciones justas o en su defecto, sanciones extremadamente irracionales en comparación con la omisión de la obligación. Este tema ha sido escogido debido a las múltiples quejas por parte de los notarios en cuanto a las elevadas sanciones pecuniarias que reciben al momento de presentar con atraso un informe, un atraso en el pago, etc. Hay que recordar que todos los notarios trabajan con línea de crédito con gran parte de sus clientes y muchas veces eso pone en apuros al servidor para cumplir con el pago de la recaudación, y es por el temor a una sanción, que muchas veces les toca cubrir ese aporte al estado de su propio pecunio. En sí, este proyecto va más enfocado al análisis de las sanciones que reciben los escribanos por el incumplimiento de la recaudación y/o pago de los servicios notariales, a través de entrevistas a notarios públicos de las ciudades de Guayaquil y Durán, análisis de la normativa legal vigente, entre otras.The general objective of this complex work exam is to analyze the responsibilities of all kinds (criminal, civil, administrative, etc.) that a notary has when celebrating an act corresponding to his daily work as a notary public.
