Análisis de la tenencia compartida en la legislación ecuatoriana.

Resumen
El presente trabajo inicialmente empezó como una propuesta al vacío legal que existía en cuanto
a la tenencia, que a la fecha de inicio de esta investigación, la normativa legal ecuatoriana
señalaba preferentemente se le otorgue la misma a la madre, sin embargo el diez de diciembre
del año 2021, la Corte Constitucional del Ecuador declaro la inconstitucionalidad en cuanto a
la preferencia de la madre en el momento de considerar latenencia; sin embargo aún existe un
vacío legal al no existir norma expresa en cuanto a la tenencia compartida, de hecho como se
mencionó en líneas anteriores por mucho tiempo siempre se dio preferencia a la madre para que
sea ella a quien se le otorgue la tenencia de los hijos menores de edad, sin que el padre también
sea considerado para poder obtener la misma, es así que esta norma era desigual para los
progenitores y por ende no existe una forma de fijar alimentos en relación a este tema, ya que
cada progenitor asumiría todos losgastos en los que se incurran, durante el periodo que el o los
hijos permanezcan a su lado. La falta de normativa legal impide que los administradores de
justicia en Ecuador puedan dirimir respecto a este tema. La Tenencia compartida es una forma
no contempladaexpresamente en nuestro ordenamiento jurídico, pero tampoco esta opuesta al
interés superior del niño, niña o adolescente.
Actualmente esto podría darse por acuerdo de ambos progenitores si así lo decidieran, pese a
no estar prevista en el CÓDIGO ORGÁNICO DE LA NIÑEZ Y ADOLESCENCIA.
