Resumen
Hoy en el marco del derecho procesal civil, se plantean -varios vacíos- algunas
opciones para la solución de este fenómeno. Se entiende a esta corriente como una
nueva forma de ver al Código Orgánico General de Procesos (COGEP), teoría por la
cual la estructuración sistemática de la teoría procesal deja de estar supeditada
únicamente a la ley, dotándose necesariamente a la jurisprudencia, a las legislaciones
comparadas o a la doctrina para explicar su naturaleza, estructura e historia, con la
finalidad de tener un mayor enfoque, de profundizar en la esencia y el contenido de
algunas figuras procesales de reciente incorporación en nuestro sistema procesal y,
sobre todo las que nos causa más dudas que certezas.
Por ser el COGEP, una norma que modifico completamente la esfera procesal civil
ecuatoriana, la presente tesis analiza tanto el procedimiento ejecutivo como el
monitorio y, la figura procesal de las providencias preventivas regulado en dicho
cuerpo legal. Para el efecto nos remontamos a los antecedentes históricos; se revisa las
clases o tipos de procedimientos que existen con sus respectivas características.
Seguidamente, se exponen los vacíos que presenta el COGEP; se estudia el tratamiento
del procedimiento monitorio según la doctrina para finalmente revisar el trámite de
aplicabilidad de las providencias preventivas en el proceso monitorio bajo los
lineamientos que se establece en el juicio ejecutivo en el COGEP. Nowadays, within the framework of civil procedural law, several options (and gaps)
are proposed to solve this phenomenon. This trend is understood as a new perspective
of the General Organic Code Of Procedures (COGEP in Spanish), the same theory by
the systematic structuring of the procedural theory ceases to be subject only to the law,
necessarily giving in to the jurisprudence, to compared legislations or the doctrine to
explain its nature, structure and history, aiming to have a greater focus, to deepen in
the essence and content of some procedural figures of recent incorporation in our
procedural system and, above all, those that cause us more doubts than certainties.
Since the COGEP is a norm that completely modified the Ecuadorian civil procedural
system, this thesis analyzes both the executive procedure as well as the payment
procedure and the procedural figure of the preventive orders regulated in said legal
body. For this purpose, we go back to the historical background; the classes or types
of procedures that exist with their respective characteristics are reviewed. Next, the
gaps the COGEP is presenting are stated; the treatment of the payment procedure is
studied according to the doctrine to finally review the applicability process of
preventive measures in the payment procedure under the guidelines established in the
executive trial in the COGEP.
