La eficacia en las resoluciones judiciales en la provincia de los Ríos.

Resumen
La presente investigación se planteó como objetivo general determinar la existencia de
una motivación adecuada en la estructura de las resoluciones judiciales, analizar las
problemáticas del incumplimiento de plazos y términos en la reducción a escrito de las
resoluciones, así como también proponer opciones para mejorar la motivación en las resoluciones
judiciales. La metodología utilizada en la presente investigación estuvo sustentada en el enfoque
cualitativo por cuanto tuvo por objeto el análisis de casos específicos en los cuales se pudo
evidenciar que en las resoluciones judiciales en la Provincia de Los Ríos periodo 2019 existieron
resoluciones dictadas fuera de los tiempos establecidos por la ley, así como también carentes de
motivación, lo que produce una vulneración del debido proceso. La investigación concluyó
señalando, que la motivación es un requisito fundamental en toda sentencia judicial a tal punto
que en caso de no existir o que la misma no cumpla con los parámetros establecidos puede ser
susceptible de anulabilidad por cualquiera de los recursos que se encuentran contemplados en la
ley, así como también la notificación de las resoluciones fuera del tiempo legal acarrea
gravísimas vulneraciones del derecho, por violaciones a la garantía del debido proceso. The general objective of this research was to determine the existence of adequate
motivation in the structure of judicial resolutions, analyze the problems of non-compliance with
deadlines and terms in the reduction of resolutions to writing, as well as to propose alternatives
for the correct motivation of court decisions. The methodology used in the present investigation
was based on the qualitative approach since it had as its objective the analysis of specific cases in
which it was possible to show that in the judicial resolutions in the Province of Los Ríos period
2019 there were resolutions issued outside of those of the times established by law, as well as
lacking motivation, which produces a violation of due process. The investigation concluded by
pointing out that the motivation is a fundamental requirement in any judicial sentence to the point
that if it does not exist or that it does not comply with the established parameters, it may be
subject to annulment by any of the resources that are contemplated in the law, as well as the
notification of resolutions outside the legal time, entails very serious violations of the right, due
to violations of the guarantee of due process.
