| dc.description | El convenio arbitral ha sido concebido como el acuerdo al que llegan ambas partes para poder
solucionar una controversia respecto de un acuerdo o situación previa que ha devenido en un
conflicto de intereses que impide continuar con lo previamente pactado, sin embargo, al
firmar un convenio arbitral se abre la posibilidad de afectar a terceros no firmantes con la
suscripción del mismo; con el advenimiento de la Sociedades por Acciones Simplificadas en
la legislación ecuatoriana se abre un importante debate del grado de afectación de este nuevo
tipo de compañías respecto de un acuerdo del cual ellos nos han sido participes,
convirtiéndose en el objeto investigativo de análisis del presente trabajo de titulación. | |
| dc.description | The arbitration agreement has been conceived as the agreement reached by both parties in
order to resolve a dispute regarding a previous agreement or situation that has become a
conflict of interest that prevents continuing with what was previously agreed, however, when
signing an arbitration agreement the possibility of affecting non-signatory third parties with
the subscription of the same is opened, with the advent of Simplified Stock Companies in
Ecuadorian legislation, an important debate is opened on the degree of affectation of this new
type of companies with respect to an agreement in which they have been participants,
becoming the investigative object of analysis of the present work degree. | |
