La motivación del fiscal en la formulación de cargos.

Resumen
La formulación de cargos deberá cumplir con los lineamientos establecidos en el
artículo 595 del COIP, sin perjuicio de la observación de las garantías del debido
proceso establecidas en la Constitución de la República. El problema central es si la
resolución de imputación que realiza el fiscal cumple con los parámetros de la
motivación. La investigación se orienta a la armonía entre la formulación de cargos, con
los derechos constitucionales, específicamente en la garantía de la motivación, como
parte del derecho a la defensa. Para ello, la metodología utilizada fue la cualitativa, que
permitió el análisis de la doctrina acerca de la imputación y del derecho a la motivación;
en la misma línea, se pudo analizar la normativa constitucional, ordinaria y la
jurisprudencia de la Corte Constitucional. De la misma manera, se realizaron entrevistas
a fiscales y expertos en derecho penal, respecto a la temática abordada. Mediante la
discusión de los resultados se pudo obtener datos acerca de la finalidad, fundamento
jurídico, características, errores y satisfacción de la motivación en la imputación que
realiza el fiscal. El aporte del presente trabajo consiste en un criterio para verificar la
motivación en la formulación de cargos, en el que se incluye los parámetros de
razonabilidad, coherencia y comprensibilidad. La conclusión a la que se arriba es que la
imputación debe cumplir no solo con los requisitos dispuestos en la ley, sino también,
con los presupuestos de la motivación, como medio de control y exclusión de la
arbitrariedad en las resoluciones del poder público. The formulation of charges must comply with those guidelines established in
article 595 of the COIP, without prejudice to the observance of the guarantees of due
process established in the Constitution of the Republic. The central problem is whether
the resolution of the imputation carried out by the prosecutor complies with the
parameters of the motivation. The investigation is oriented to the harmony between the
formulation of charges, with the constitutional rights, specifically in the guarantee of the
motivation, as part of the right to defense. To do this, the methodology used was
qualitative, which allowed the analysis of the doctrine about the imputation and the
right to motivation; Along the same lines, it was possible to analyze the constitutional
and ordinary regulations and the jurisprudence of the Constitutional Court. In the same
way, interviews were conducted with prosecutors and experts in criminal law, regarding
the issue addressed. Through the discussion of the results, it was possible to obtain data
about the purpose, legal basis, characteristics, errors and satisfaction of the motivation
in the imputation made by the prosecutor. The contribution of this work consists of a
criterion to verify the motivation in the formulation of charges, which includes the
parameters of reasonableness, coherence and understandability. The conclusion reached
is that the imputation must comply not only with the requirements established in the
law, but also with the presuppositions of the motivation, as a means of control and
exclusion of arbitrariness in the resolutions of the public power.
