Resumen
El presente trabajo tiene por finalidad demostrar que el derecho de eliminación
establecido en el artículo 15 de la Ley Orgánica de Protección de Datos
Personales la cual entró en vigencia el 26 de mayo de 2021 es la opción
idónea para solicitar a las autoridades correspondientes la eliminación de
datos personales que reposan en la página del Sistema Automático de
Trámite Judicial Ecuatoriano SATJE, herramienta administrada por la Función
Judicial cuando dicha información que surge de un proceso sometido a la
justicia haya culminado, ya sea por diferentes razones, como cuando un
proceso judicial en materia no penal se ha dictado sentencia que rechaza la
demanda, autos resolutivos e interlocutorios que impliquen la conclusión del
proceso o en materia penal cuando se haya declarado la inocencia, o cuando
se ha dictado sentencia ratificatoria de inocencia, archivo de la investigación
previa, sobreseimiento o extinción de la acción penal conjuntamente así como
también cumplimiento de la sentencia, debido a que la información que reposa
en este sistema que es de libre acceso lesiona los derechos de intimidad,
honor y buen nombre haciéndonos susceptibles de discriminación por parte
de la sociedad por nuestro pasado judicial por haber estado involucrado en
una contienda legal y cuyo almacenamiento ya no es relevante para nuestro
entorno. The purpose of this paper is to demonstrate that the right of deletion
established in Article 15 of the Organic Law on Personal Data Protection,
which entered into force on May 26, 2021, is the appropriate option to request
the corresponding authorities to delete personal data contained in the page of
the Ecuadorian Automatic Judicial Processing System SATJE, a tool
administered by the Judicial Function when such information arising from a
process submitted to justice has already culminated either for different reasons
such as when a judicial process in non-criminal matters has been issued a
judgment rejecting the claim, In criminal matters, when innocence has been
declared, or when a ratifying sentence of innocence has been issued, the
preliminary investigation has been closed, dismissal or extinction of the
criminal action has been issued jointly, as well as compliance with the
sentence, The information that rests in this system, which is of free access,
harms the rights of privacy, honor and good name, making us susceptible to
discrimination by society because of our judicial past for having been involved
in a legal dispute and whose storage is no longer relevant to our environment.
