La mediación previa en materia transigible de niñez y adolescencia : una propuesta de reforma al Código Orgánico General de Procesos (COGEP).

Resumen
La Constitución ecuatoriana del año 2008 reconoció la posibilidad del empleo de los
Mecanismos Alternos de Resolución de Conflictos, lo que legitima el uso de los mismos en la
práctica jurídica nacional. En los procesos judiciales por cuestiones relacionadas a la niñez y
adolescencia, los jueces muchas veces derivan los procesos a mediación. Plantear la posibilidad
de que, en estos asuntos, las partes accedan a la mediación como requisito previo antes de ir a
un proceso judicial, constituye un planteamiento de gran valor, no solo para los intervinientes,
sino para la propia administración de justicia, reduciéndose los costos y el tiempo en la
solución de los litigios. A partir de estos antecedentes, este estudio se plantea como objetivo
general el demostrar la pertinencia de incluir la mediación previa en materia de niñez y
adolescencia y de reformar con ese objeto el Código Orgánico General de Procesos (COGEP);
lo que se intentará por medio de una metodología cualitativa y cuantitativa con un enfoque
descriptivo, por lo que a través de métodos como el histórico, analítico, deductivo y estadístico,
y técnicas como la revisión documental y la entrevista, se intentará establecer los beneficios y
la necesidad de reformar el COGEP, a los efectos de incluir la mediación previa en materia
transigible niñez y adolescencia en el sistema procesal ecuatoriano. Con el estudio se ha podido
concluir la relevancia de insertar la mediación previa como requisito de procedibilidad para
iniciar un proceso judicial en materia transigible de niñez y adolescencia. The Ecuadorian Constitution of the year 2008 has recognized the possibility of using the
Alternate Conflict Resolution Mechanisms, which legitimizes their use in national practice. In
judicial proceedings for issues related to children and adolescents, judges often refer to
mediation processes. Raising the possibility that, in these matters, the parties access mediation
as a prerequisite and mandatory before going to court, is an approach of great value, not only
for those involved, but for the administration of justice itself, reducing the costs and the time in
the solution of the litigations. Based on this background, the study aims to demonstrate the
relevance of including prior and mandatory mediation in General Organic Code of Processes
(COGEP); which is achieved through a qualitative and quantitative methodology with a
descriptive approach, so through methods such as historical, analytical, deductive and
statistical and techniques such as documentary review and interview; It is possible to
demonstrate the benefits and the need to reform the COGEP, in order to include prior and
compulsory mediation in the issues of childhood and adolescence that are known in Ecuador
by the courts. With the study it has been possible to conclude the relevance of being able to
insert this type of mediation, as a procedural requirement in processes of that nature.
