El objeto social único en la sociedad anónima mercantil como limitante a la libertad de empresa.

Resumen
Mediante el presente ensayo se buscará explicar los aspectos más relevantes respecto al objeto social en las
sociedades mercantiles tanto en la legislación ecuatoriana, como en el derecho comparado, y cómo la limitación del mismo, mayoritariamente en las sociedades de capital, puede desencadenar en la vulneración de derechos fundamentales, consagrados en la Constitución de la República del Ecuador(2008). Para efectos del estudio se explorará las características propias de la sociedad anónima a efectos de lo que señala la doctrinay la legislación ecuatoriana. Así mismo, se enfocará en la trascendencia del objeto social en las sociedades
mercantiles, abarcando lo que señalan las tendencias modernas frente al tema, así como la doctrina. Además
se detallará sobre el carácter constitucional de la libertad de empresa y su intrínseca relación con el objeto
social de las compañías. Con dichos planteamientos se logrará una visión integral del tema y permitirá un mejor entendimiento de la trascendencia del objeto social de las sociedades mercantiles en el desarrollo económico de un país, y su necesaria protección en el ámbito constitucional.
