Resumen
El Control Judicial del ejercicio de la facultad discrecional administrativa tiene la finalidad de que una instancia judicial, en este caso la jurisdicción contenciosa
administrativa, controle los actos de la administración en virtud de principios
como el de tutela judicial efectiva. Cabe recalcar que antes en el algunos Estados incluyendo el nuestro se dejaba fuera de competencia a la vía judicial respecto de la impugnación de los actos administrativos discrecionales, pero ahora acogiendo las nuevas tendencias de Estado de Derechos y Justicia, se promovió la idea de abrir la vía judicial para que de esta manera todo tipo de actos emanados de la administración puedan ser impugnados, sin necesidad de
agotar la vía administrativa. Por otra parte una de las soluciones que da la doctrina para guiar a los jueces a ejercer el control del acto administrativo discrecional, son las técnicas de control de discrecionalidad, las cuales hacen hincapié en todos los factores que dieron nacimiento a ese acto administrativo para de esta forma encontrar la solución al acto controvertido.
