Daño moral como consecuencia de una demanda de presunción de paternidad con una prueba negativa de ADN.

Resumen
La demanda de presunción de la paternidad es un procedimiento legal para establecer la relación parental entre individuos, pero existen casos en que, una vez elaborada la prueba de ADN, esta da un resultado negativo, ante lo cual el Juez debe emitir sentencia desechando la demanda. Pero queda la duda de si aquello da paso a que el sujeto pueda demandar por daño moral como
consecuencia del perjuicio que la demanda anterior le pudo haber ocasionado.
La ley ecuatoriana no establece tal supuesto por ende, si se limita a lo taxativo,
se cree que únicamente se puede establecer este tipo de daño por dolo pero si
se analiza con profundidad el contenido de la misma norma se podría reconocer
que al hablar de daño éste siempre es resarcible. Como consecuencia, está la
posibilidad de que si la situación ha creado un daño personal al individuo este
estaría en todo su derecho de exigir un resarcimiento.
