This dissertation is particularly interested in determining the incidence of establishing the imprescriptibility in the crime of murder, through an analytical-legal study, where the violation of guaranteeing effective criminal responsibility to sanction criminal behavior that goes against the law is determined. life, benefiting the alleged offender, at the time that the punitive power of the State is not exercised for the period of time determined by law, leaving the non-existence of a social recomposition by altering legal and social security, and deriving impunity in the process, thanks to this procedural premise called Prescription, the same one that also has an important role in this research project, as well as a proposal for the sake of a constitutional and penal reform in order to solve the problem raised.Esta disertación tiene su interés particularmente en determinar la incidencia de establecer la imprescriptibilidad en el delito de asesinato, por medio de un estudio analítico – jurídico, donde se determina la vulneración de garantizar una efectiva responsabilidad penal para sancionar conductas delictivas que van en contra de la vida, beneficiando al presunto infractor, al momento que el poder punitivo del Estado no llega a ejercerse por el transcurso de tiempo determinado en la ley, dejando la inexistencia de una recomposición social al alterar la seguridad jurídica – social, y derivando la impunidad en el proceso, gracias a esta premisa procesal llamada Prescripción, la misma que también tiene el rol más importante en este proyecto investigativo, así como también se sugiere una propuesta en aras a una reforma constitucional y penal con el fin de solucionar la problemática planteada.
