This research involves two legal institutions of our legislation, the Special
Prescription Domain purchasing and Homestead, both with a transcendental
and undeniable legal and social importance. Similarly, both prescription and
heritage are intended to base their discussion, real estate.
When there is actual possession of property, with the intention of lord or
master, without violence, interruption or hiding and showing that this has
happened over the last fifteen years, we can argue before a justice operator
compliance with the law and therefore the right to own that property for
"extraordinary prescription domain", as established in Section 2410 of the
Civil Code, in addition, adverse possession is an original mode of acquiring
ownership, based on the possession for a specified period of movable or
immovable, which are in the human trade and therefore are prescriptive,
according to Article 2398 of the Civil Code.
If the actual possession of real property, which has met all requirements to
be declared as such, falls on an asset that has "family assets" will not be
possible to allege it as "extraordinary prescription domain" because of that
property with heritage family has the purpose or purposes that lie outside the
trade and apart from any action by creditors, and therefore a fundamental
effect of family assets is that belonging to it are inalienable and indefeasible.
The consultation theoretical and field research were conducted for this work
have allowed me to expose foundation criteria and submit both the analysis
and verification of the objectives and the testing of the hypothesis initially
proposed, as well as expose the legal reform that I suggest be included in
our legislation. En esta investigación intervienen dos instituciones jurídicas de nuestra
legislación, la Prescripción Extraordinaria Adquisitiva de Dominio y el
Patrimonio Familiar, ambas con una trascendental e innegable importancia
jurídica y social. De igual forma, tanto la prescripción como el patrimonio
tienen como objeto base de su discusión, un bien inmueble.
Cuando existe posesión efectiva de un bien, con ánimo de señor o dueño,
sin violencia, interrupción ni clandestinidad y demostrando que esto ha
ocurrido durante los últimos quince años, permite alegar ante un operador
de justicia el cumplimiento de la ley y por lo tanto, el derecho a poseer dicho
bien por “prescripción extraordinaria de dominio”, conforme lo establece el
Art. 2410 del Código Civil; además, la prescripción adquisitiva es un modo
originario de adquirir el dominio, fundamentada en la posesión por un tiempo
determinado de bienes muebles o inmuebles, que están en el comercio
humano y por lo tanto son prescriptibles, según el Art. 2398 del Código Civil.
Si la posesión efectiva de un bien raíz, que ha cumplido todos los requisitos
para ser declarada como tal, recae sobre un bien que tiene “patrimonio
familiar” no será posible alegarla como “prescripción extraordinaria de
dominio” en razón de que los bienes con patrimonio familiar tienen por
objeto o finalidad el de que queden fuera del comercio y al margen de toda
acción de los acreedores; y, por ello, un efecto fundamental del patrimonio
familiar es que los bienes que lo constituyen son inalienables e
inembargables.
La consulta teórica y la investigación de campo que se realizaron para este
trabajo, me han permitido exponer criterios con fundamento y presentar tanto
el análisis y verificación de los objetivos como la contrastación de la
hipótesis planteados inicialmente; así como exponer la reforma jurídica que
sugiero incluirse en nuestra legislación.
