The Universal Declaration of Human rights is one of the most wide
dispositions of the international document and shelters all the rights relating
to the workers, admits that every person has rightly to the work, to selecting
his employment, to the social protection against the unemployment, to the
remuneration for his employment, to the union organization and that should
not be discriminated to the moment to receive a salary, that is to say, every
person who works has right to an equitable and satisfactory remuneration,
which he assures him, as well as to his family, an existence in conformity
with the human dignity and that will be completed, in necessary case, by
any other means of social protection.
The Labor Laws will be inspired in the harmony between the capital and the
work as factors of production, the State owes tutelary the rights of the
workers, and at the same time to protect the capital and to the employer, the
work is an inexhaustible source of rules and agreements, which because of
the work to executing can derive as useful instruments to the sources of
production, which turn them into juridical procedure, and to become
effective.
The worker, is every natural person who gives other one or others, natural
or juridical, material, intellectual services, or of both kinds, by means of the
payment of a remuneration and by virtue of a contract or relation of work,
and in addition it thinks every natural person named employee, laborer,
employee, worker, commission agent, operative, office worker, agent, that it
gives the service or executes the works personally, for an employer in
exchange for a remuneration.
The labor law, it protects the workers establishing minimal guarantees, to
which they must subject the contracts of work, and any disposition that limits
or eliminates these minimal rights will be considered to be like void, being
based in the general beginning of justice, equity and equality, but also he
attends to own exclusive beginning of the labor matter, one of importance is
the protective beginning that it seeks to attend principally the worker, that in
favor of the doubt, that is to say, that in case of uncertainty will look for the
most favorable interpretation for the worker, during the labor contractual
relation. La Declaración Universal de Derechos Humanos es una de las
disposiciones más amplias del documento internacional y cobija todos los
derechos referente a los trabajadores, reconoce que toda persona tiene
derecho al trabajo, a seleccionar su empleo, a la protección social contra el
desempleo, a la remuneración por su empleo, a la organización sindical y a
que no se le discrimine al momento de recibir un salario, es decir, toda
persona que trabaja tiene derecho a una remuneración equitativa y
satisfactoria, que le asegure, así como a su familia, una existencia
conforme a la dignidad humana y que será completada, en caso necesario,
por cualesquiera otros medios de protección social.
Las Leyes Laborales estarán inspiradas en la armonía entre el capital y el
trabajo como factores de producción, el Estado debe tutelar los derechos
de los trabajadores, y al mismo tiempo proteger el capital y al empleador, el
trabajo es fuente inagotable de preceptos y acuerdos, que por razón del
trabajo a ejecutar pueden derivar como instrumentos útiles a las fuentes de
producción, que las convierten en normas jurídicas, y se vuelven eficaces.
El trabajador, es toda persona natural que preste a otra u otras, natural o
jurídica, servicios materiales, intelectuales, o de ambos géneros, mediante
el pago de una remuneración y en virtud de un contrato o relación de
trabajo, y además se considera a toda persona natural denominada
asalariado, jornalero, empleado, obrero, comisionista, operario, oficinista,
agente, que presta el servicio o ejecuta las obras personalmente, para un
patrono a cambio de una remuneración.
El derecho laboral, protege a los trabajadores estableciendo garantías
mínimas, a las que deben sujetarse los contratos de trabajo, y cualquier
disposición que limite o elimine estos derechos mínimos se considerará
como nula, basándose en los principios generales de justicia, equidad e
igualdad, pero también atiende a principios propios exclusivos de la materia
laboral, uno de importancia es el principio protector que busca asistir
principalmente al trabajador, que en favor de la duda, es decir, que en caso
de incertidumbre se buscará la interpretación más favorable para el
trabajador, durante la relación laboral contractual.
