O fenômeno das agências reguladoras é particularmente recente em nosso sistema jurídico. A idéia de um Estado regulador que priorize a capacidade técnica e gerencial da iniciativa privada em certas áreas econômicas e sociais contrasta com a tradição política do Brasil. Mas tal inovação repercute no Direito, criando indagações para o cientista jurídica, tais como qual seu poder normativo e qual sua legitimidade democrática. Para responder tais perguntar, é preciso realizar uma análise tanto do ponto de vista histórico quanto do ponto de vista jurídica. Somente por este caminho será possível responder as indagações pertinentes a fim de lançar um olhar para o futuro.The phenomenon of the regulatory agencies is particularly recent in our legal system. The Idea of a regulatory State that prioritizes the technical and managerial capacity of the private initiative in social and economical areas contrasts with Brazil’s political tradition. But such innovation repercusses at the Law, creating questionings for the legal scholar, such as what is its normative power or what is its democratic legitimacy. In order to answer such questions, it is necessary to perform an analysis either from a historical as from a legal viewpoint. Only through that way it will be possible to answer the pertinent questionings in order do give a look to the future.
