The paralyzation of public transport is a problem that the Ecuadorian State has not been able to eliminate in recent years, being necessary to exclude it from the citizen environment. The objective is to analyze the non-application of the sanctioning power of the public administration in the paralyzation of the provision of the public transport service in the canton of Cuenca. The research was of mixed type, methods such as inductive-deductive, historical-logical and descriptive were applied. It was determined as a result that the administration of the Municipal GAD of the canton Cuenca, sanctioned the public transport operators for interrupting or suspending the provision of public service; however as a contribution, it was established the need to propose reforms to the existing regulations, both the Organic Law of Land Transport, Transit and Road Safety and the Ordinance that regulates the procedure for the granting of enabling titles of land transport in the canton, Rules regulating land transport in the Ecuadorian State and in the Cuenca canton.La paralización del transporte público es una problemática que, el Estado ecuatoriano no ha podido eliminar en los últimos años, siendo necesario excluirlo del medio ciudadano. El objetivo es analizar la no aplicación de la facultad sancionadora de la administración pública en la paralización de la prestación del servicio del transporte público en el cantón Cuenca. La investigación fue de tipo mixta, se aplicaron métodos como el inductivo-deductivo, histórico-lógico y descriptivo. Se determinó como resultado que la administración del GAD Municipal del cantón Cuenca, sancionó a las operadoras de transporte público por interrumpir o suspender la prestación del servicio público; sin embargo, como aporte se estableció la necesidad de plantear reformas a la normativa vigente tanto Ley Orgánica de Transporte Terrestre, Tránsito y Seguridad Vial y la Ordenanza que regula el procedimiento para el otorgamiento de Títulos Habilitantes de transporte terrestre en el cantón Cuenca, normas que regulan el transporte terrestre en el Estado ecuatoriano y en el cantón Cuenca.
