| dc.description | El presente trabajo de investigación tiene por finalidad resolver el problema socio-normativo en que participa la legislación peruana, que se caracteriza por
la ausencia de enunciado normativo alguno que ponga de manifiesto a sus destinatarios el modo en que se regula tácitamente el despido de trabajadores
durante el período vacacional en el Perú.
Para tal efecto, se procede, en primer lugar, a evidenciar aquella regulación tácita por medio de deducciones a partir de enunciados normativos positivos
preexistentes y, una vez clara la normativa tácita (que se sigue de la normativa
expresa), se ofrece un enunciado normativo categórico, reflejo de aquella regulación tácita del asunto en cuestión, por cuyo mérito se haga público el modo en que, según el derecho vigente, se debe proceder a despedir o no a un
trabajador según la posición en que se encuentre este frente al período vacacional. | |
| dc.description | The purpose of this paper is to provide a solution to a social and normative problem in which Peruvian labor law is involved, a problem that is characterized
by the absence of a normative statement that brings to light the tacit (implied)
regulation about (fair) dismissal during the vacation period in Peru.
To that effect, the tacit regulation previously mentioned is revealed and explained by an inference processing from the positive and pre-existing law (the
premises) to what would be a suitable example of the categorical normative proposition or statement that reflects that tacit regulation of the matter (the conclusion). Revealing such issue, it will be common knowledge how to fairly
proceed in layoffs during the vacation period in Peru. | |
