La sanción procesal de la ley de filiación de paternidad extramatrimonial y la afectación de principio de interés superior del Niño en el Perú

Resumen
En la Ley Nº 30628 que establece el proceso de filiación de paternidad extramatrimonial. De manera que, si el demandado no acepta realizarse la prueba biológica de ADN dentro del plazo legal. Así mismo, el juez se encuentra obligado a dictar sentencia declarando la paternidad extramatrimonial. Por esta razón, se considera que se afecta el principio de interés superior del niño.
La presente investigación tiene como objetivo determinar la afectación de los derechos del menor. Ya que, en el desarrollo del proceso sin la práctica de la prueba de ADN por parte del obligado presenta una clara transgresión. Por lo tanto, se tiene que analizar las graves consecuencias que genera la preclusión procesal. Por todo ello, mediante el método de argumentación jurídica se postuló que el juez ordene la detención de grado o fuerza del demandado.
La investigación es de tipo jurídico dogmático – interpretativo. Asimismo, haciendo uso de los métodos dogmáticos, hermenéutico, exegético, y argumentación jurídica. Además, en dicha perspectiva metodológica se empleó la técnica documental, cuyos instrumentos fueron las fichas textuales, de resumen, análisis de contenido y registro de información.
