Fundamentos teórico-dogmáticos que sustentan la categorización de la habitualidad ante la recurrencia del acceso al principio de oportunidad

Resumen
En
el presente trabajo se ha investigado tanto la dimensión dogmática como empírica del principio de
oportunidad para obtener los fundamentos teórico dogmáticos que sustentan la categorización de la
habitualidad ante la recurrencia del acceso al principio de oportunidad ; ello con el propósito de
establecer si el supuesto del literal b) del numeral 9 del artículo 2 del Código P rocesal Penal, con la
comisión de un tercer hecho punible, cumple con los presupuestos exigidos por la agravante
cualificada de Habitualidad prescrita en el artículo 46 C del Código Penal concordan te con el Acuerdo
Plenario N°01 2008. Para ello se ha llevado a cabo la investigación en primer lugar, con utilización
del método dogmático para la comprensión del contenido que se otorga al propio principio de
oportunidad en relación con otros principios relativos como el principio de presunción de inocencia,
así como, en virtud de las consecuencias que lo afectan, como ocurre con el caso de la reiteración de
la conducta comisiva; dicho análisis requirió de un a investigación con enfoque cualita tivo, finalidad
básica y desarrollo dogmático que utilizó como método general al análisis y síntesis de las figuras
dogmáticas antes mencionadas y como métodos específicos el dogmático jurídico y el argumentativo;
así como, las técnicas de revisión sistemá tica cualitativa de fuentes y el análisis documental . Los
principales resultados obtenidos a partir del estudio de las concepciones precedentemente indicadas,
se sustentan, en que el agente que se encuentra inmerso en el supuesto del literal b) del numeral 9
del artículo 2 del CPP al cometer un tercer hecho punible, es considerado habitual, por lo tanto,
requiere un merecimiento de una pena más grave, a efectos de neutralizar su proclividad a cometer
el mismo delito. In the present investigation, both the dogmatic and empirical dimensions of the principle of opportunity have been investigated to obtain the theoretical-dogmatic foundations that support the categorization of habituality in the face of the recurrence of access to the principle of opportunity; this with the purpose of establishing if the assumption of literal b) of numeral 9 of article 2 of the Code of Criminal Procedure, with the commission of a third punishable act, complies with the assumptions required by the qualified aggravating circumstance of Habituality prescribed in article 46- C of the Penal Code consistent with Plenary Agreement No. 01-2008. For this, the research has been carried out, firstly, using the dogmatic method for understanding the content that is given to the principle of opportunity in relation to other relative principles such as the principle of presumption of innocence, as well as, by virtue of the consequences that affect it, as occurs with the case of the reiteration of the commissive behavior; This analysis required an investigation with a qualitative approach, basic purpose and dogmatic development that used as a general method the analysis and synthesis of the aforementioned dogmatic figures and as specific methods the legal dogmatic and the argumentative; as well as the techniques of qualitative systematic review of sources and documentary analysis. The main results obtained from the study of the aforementioned conceptions are based on the fact that the agent who is immersed in the assumption of literal b) of numeral 9 of article 2 of the CPP when committing a third punishable act, is considered habitual, therefore, requires a deserving of a more serious penalty, in order to neutralize their propensity to commit the same crime.
