Los elementos valorativos válidos para legitimar la intervención penal en el estado constitucional

Resumen
La finalidad de la presente tesis fue; determinar los elementos valorativos válidos para legitimar la intervención penal en el marco de un Estado Constitucional, realizándose para tal fin un trabajo de investigación teórica, no experimental transversal, descriptiva, donde la unidad de análisis estuvo conformada por las fuentes formales del derecho. Los métodos empleados fueron el dogmático, exegético, hermenéutico y la argumentación jurídica; y dentro de las técnicas empleadas figuran el fichaje y el análisis de contenido. Como resultados de la investigación se tiene que, en cuanto Derecho penal de un Estado social, encuentra su legitimación como sistema de protección efectiva de los ciudadanos, en la función de prevención en la medida de lo necesario para aquella protección, lo que constituye ya un límite de la prevención; mientras que el Derecho penal de un Estado democrático de Derecho deberá someter la prevención penal a otra serie de límites, algunos herederos de la tradición liberal del Estado de Derecho, y otros reforzados por la necesidad de llenar de contenido democrático el Derecho penal. Concluyendo que los elementos valorativos válidos para legitimar la intervención penal están en relación a los elementos irrenunciables que tienen como trasfondo los principios y derechos constitucionales; constituyéndose en límites infranqueables: el principio de legalidad sustancial (la dignidad de la persona), el principio de proporcionalidad (subsidiariedad, ultima ratio), el principio de culpabilidad (presunción de inocencia), no admisión de excepciones, (principio de igualdad), al ejercicio del ius-puniendi estatal Tesis
