| dc.description | The relationship between the restorative paradigm and settled institutes moves in the strictly instrumental sphere. Beyond what they might seem initially, both concepts are not synonymous. In fact, these are criminal justice models that respond to rather different foundations, although they are interconnected. With the conviction that restorative justice, and particularly mediation - represents an option of interest for the 21st century Spanish Criminal Justice, this paper questions the undue identification -more than frequent, by the way-, between the negotiated justice and the so-called the new Criminal Law paradigm. | en-US |
| dc.description | La relación entre el paradigma restaurativo y los institutos paccionados se mueve en el terreno de lo estrictamente instrumental. Lejos de lo que inicialmente pudiera parecer, no son conceptos sinónimos. Se trata, en realidad, de modelos de Justicia penal que, aun cuando interconectados, responden a fundamentos bien diferentes. En el convencimiento de que la Justicia restaurativa –y, en particular, la mediación− representa una opción de interés para la Justicia penal española del siglo XXI, el presente trabajo entra a cuestionar la indebidaidentificación −más que frecuente, por cierto−, entre la Justicia negociada y el denominado nuevo paradigma del Derecho penal. | es-ES |
