In the recent Xákmok Kásek Indigenous Community v. Paraguay case, the Inter-American Court was faced with the matter of the unborn child’s status. However, the Court avoided issuing a decision in this regard. As a reaction, this article purports to interpret the American Convention on Human Rights, elucidating the meaning of the norm stating that the right to life shall be protected, "in general, from the moment of conception". En el reciente caso Comunidad Indígena Xákmok Kásek Vs. Paraguay, la Corte Interamericana se vio enfrentada al tema del estatus del no nacido, pero decidió no pronunciarse sobre este asunto. Este artículo, como reacción a dicha decisión, busca interpretar el Pacto de San José, desentrañando el sentido de la norma que dispone que el derecho a la vida deberá protegerse, "en general, a partir del momento de la concepción".
