El presente documento de trabajo tiene como objetivo analizar la regulación constitucional de la salud, específicamente la salud como derecho fundamental. En él se analizan en forma concisa el texto constitucional, las interpretaciones judiciales más relevantes y la doctrina constitucional. En consecuencia, el apartado se divide en dos secciones: En la primera sección (I), se aborda la regulación constitucional de la salud, distinguiendo entre las distintas funciones que cumple la salud dentro del régimen constitucional (la salud como derecho fundamental, la salud como valor vinculado a otros derechos fundamentales, la salud como bien tutelado por sí); en la segunda sección (II) se precisa el derecho fundamental a la salud a la luz de las interpretaciones judiciales y la doctrina constitucional, a fin de desentrañar las implicaciones normativas del texto constitucional.The current working paper is looking to analyze the constitutional regulation on health, specifically health as a fundamental right. It consists of a concise analysis of the constitutional text, as well as the most relevant judicial interpretations and constitutional doctrine in Mexico. Accordingly it is divided in two sections: in the first section (I), the constitutional regulation to health and the different functions that healh fulfills within the constitutional regime (health as a fundamental right, health as a right linked to other fundamental rights, and health as a good protected in itself) will be addressed; in the second section (II) the fundamental righ to health will be analyzed further in light of judicial interpretation and constitutional doctrine, to unravel the normative implications of the constitutional text.
